- Acceptance of Terms
By accessing or using CHAADU (the “platform”), provided by Chaadu B.V. (“we”, “us”, or “our”), you agree to be bound by these Terms of Use. These terms constitute a legally binding agreement between CHAADU and you, whether you are a hospitality professional, an employer, and/or a guest (collectively, “user”, “you”).
- User Categories and Eligibility
The platform serves three primary categories of users:
- Hospitality professionals: individuals (e.g., managers, service staff) using the platform to build their reputation through reviews and additionally can receive acknowledgements through tipping.
- Employers: business entities or individuals using the platform to monitor performance and generate reports based on reviews and feedback.
- Guests: individuals using the platform to leave reviews or provide tips to hospitality professionals.
By using the platform, you represent that you have the legal capacity to enter into this agreement. Professionals and employers represent they have the authority to bind their respective businesses to these terms.
- Description of Services
CHAADU provides a multi-faceted hospitality suite:
- Professional profile: online representation and business card for the hospitality professional.
- Performance reporting: reports for employers to generate reports on service quality and feedback trends.
- Guest feedback and tipping: a secure interface for guests to submit reviews and process digital tips for hospitality professionals.
- AI tools: tools for guests to generate AI-driven draft reviews [in testing].
- Review Policy and User Conduct
To maintain the integrity of the platform, all users must adhere to the following:
- Authenticity: reviews must be based on genuine service experiences. Guests are limited to one review per professional per day to ensure authenticity.
- Acceptable content: all feedback must be respectful. CHAADU reserves the right to remove reviews containing hate speech, harassment, or verified false information. We utilize AI-driven moderation and rewriting tools to proactively identify and mitigate such instances [in testing].
- Prohibitions: users shall not input sensitive personal data (e.g., health information, private financial details) into AI generation fields or public profiles. By voluntarily including such information in a public profile, users acknowledge and accept full responsibility for its disclosure.
- Tipping and Financial Obligations
The platform provides tools for tipping subject to the following financial and tax obligations:
- Direct rewards: CHAADU facilitates tipping through third-party payment processors. Tips are intended as direct rewards for excellence.
- Tax responsibility: professionals are solely responsible for reporting and paying any applicable income taxes or social contributions on tips received through the platform.
- Savings goals: while professionals may link tips to personal missions (e.g., courses, charity), CHAADU does not guarantee the final allocation of these funds.
- Employment relationship: CHAADU is not responsible for the underlying employment relationship or any payroll obligations arising from tips.
- Relationship of Parties
The use of the platform does not create an employment relationship between CHAADU and its users:
- No employment relationship: CHAADU is a service provider and is not a party to any employment agreement between a professional and an employer.
- Profile ownership: employers may access staff performance insights for evaluation purposes, but the individual professional retains ownership of their personal profile and reputation data.
- Employment decisions: any decisions made by employers (e.g., promotions, hiring, or terminations) based on CHAADU data or reports are made at their sole discretion and risk.
- AI Disclaimer and Responsibilities
The following disclaimers apply to all AI-generated content and tools provided on the platform:
- Content accuracy: users acknowledge that AI-generated content (e.g. translations, review drafts) may occasionally be inaccurate. While we strive to validate content in English and Dutch, we cannot guarantee the accuracy of translations in other languages, which are provided without thorough manual review.
- Human oversight: guests are solely responsible for reviewing and verifying the accuracy of any AI-generated text or data before submission. All AI-generated text or data incorporated into reports derived from information regarding hospitality professionals will be subject to human oversight and verification by us prior to being acted upon or utilized for formal evaluations.
- Data Handling and Compliance
All users must comply with the following data protection and ownership standards:
- Ownership: users retain rights to the original content they upload.
- Lawful basis: professionals and employers warrant they have the legal right (under GDPR or local laws) to process any data they input into the platform.
- Limitations of Liability and Service Availability
CHAADU’s responsibility for service delivery and damages is limited as follows:
- Service availability: we strive for continuous access via QR codes and our web interface but do not guarantee 100% uptime or uninterrupted service.
- Liability cap: CHAADU shall not be liable for indirect, incidental, or consequential damages, including loss of reputation, loss of profits, or errors in AI-generated data.
- Total liability: our total liability is limited to the amount paid by you for the service in the 12 months preceding the claim.
